Introduction
This Website is owned and provided by SC ERPK WEB SA, a company with its registered office in Romania, 53 Calea Plevnei, Sector 1, Bucharest. (Tax Identification Number RO23710295, registered under J40/6578/11.04.2008)
Please read carefully these terms before using our Website. They contain important information about your rights and obligations. Your use of our Website constitutes your acceptance of our Terms of Use and your agreement to be bound by them. If you do not accept them, or any part of them, please do not use this Website.
SC ERPK WEB SA is registered at A.N.S.P.D.C.P with the number 10366.
Age regulation
You must be over 14 years old in order to use eRepublik. Users aged between 14 to 18 must have their parents or legal guardian permission to use our Website. We reserve the right to close any account if such permission has not been granted.
Content
- Please notify that we are not responsible for the site content provided by a third party and we do not guarantee that users will comply with our Terms of Use and will behave properly. However, we reserve the right to monitor and take action upon inappropriate use of this website.
- All the users of eRrepublik can create content on the site. Therefore there are some rules to be followed regarding this. You must NOT:
- use profanity or obscenities of any kind, even disguised with asterisks; - use attacks on other participants; - use defamatory, racist, obscene, indecent, pornographic, violent, abusive, insulting, threatening and harassing comments, avatars or pictures; - use advertising or marketing of any kind, including non-profit organizations; - transmit any unsolicited, unauthorized advertising or promotional materials, that are in the nature of "junk mail", "spam", "chain letters",
"pyramid schemes", or any other form of solicitation that ERPK Web considers in its sole discretion to be of such nature; - transmit Content that infringes or violates any third party rights or violates any law or regulation; - impersonate any person or entity without their consent, including, but not limited to, a ERPK Web employee, or falsely state or otherwise
misrepresent your affiliation with a person or entity; - transmit Content that contains any viruses, Trojan horses, worms, spyware, time bombs, cancelbots or other computer programming routines that are
intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; - attempt to gain access to any other user's account or password; - create multiple accounts;
Your account
- To use our website and become a member of eRepublik you must create an account. Please be careful when choosing your user name; this must not infringe the rights of any third party, ERPK Web staff or other users. Moreover, your user name must not be confusing, offensive, racist, obscene, hurtful, unlawful. Do not use special characters. Otherwise, we will not accept your user name and, if you still want to create an account, we reserve the right to change an user name we consider to be inappropriate. You are fully responsible for all activities conducted through your account or under your account name.
- You must use a valid e-mail address. We reserve the right to test this at any time.
- When you subscribe, you guarantee that you provide true, accurate, current and complete information about yourself, maintain and promptly update your personal details. ERPK Web reserves all rights to vigorously pursue legal action against all persons who provide misleading personal information or are otherwise untruthful about their identity, and to suspend or cancel Accounts registered with inaccurate or incomplete information. Despite of this requirement, you acknowledge that ERPK Web cannot guarantee the accuracy of any information submitted by any user of eRrepublik, nor any identity information about any user. Please keep in mind that your private information is seen only by us (eRepublik team) and used only for marketing and research purposes.
- To keep your password safe, please do not disclose it to any other person. You are the sole responsible for the activities of all persons who use your password to gain access to your account. To ensure more the safety of your password, you must keep your computer free of viruses and other malicious code including Trojans. To protect the your data confidentiality (user name, e-mail, password), you may not share those with or transfer them to any third parties. You must notify us immediately of any unauthorized use of them or any other breach of security regarding our website that comes to your attention.
- An user can create and administrate a single eRepublik account.
- You can cancel your account any time for any reason; however, there are no refunds for cancellation. It will take 7 days until your account will be definitively deleted from our database. Still all your actions will remain recorded in the eRepublik history. If we consider that our Terms of Use have or might have been breached, we reserve the right to take action, without prior notice. These actions may consist in terminating or modifying your account. Terminating an account means locking/ suspending, temporarily or permanently banning the account.
- Logging-in into an account is permitted directly only from the game start page. Automatic opening of an account, no matter if the start page is displayed or not, is prohibited.
- Users can be blocked temporarily or continuously at the carriers discretion. The blocking could also be for any and/or all services.
- All accounts, including their resources, units, etc. are virtual objects of eRepublik. The user does not obtain ownership or any other rights for the account. All rights are reserved by the carrier. No rights, in particular exploitative rights, are given to the user.
- Without written permission of the carrier, it is prohibited to agree with third parties upon the transfer, the utilization or the provision of accounts or access data. In particular, it is prohibited to sell accounts or resources, or to make any other profit by leaving accounts or resources to third parties. The same applies to selling access data, rights of utilization as well as any other attempt to evade this regulation. Violations of these or other rights of the carrier, in particular copyrights, will be reported to authorities and prosecuted.
- It is not prohibited to transfer accounts finally and free of charge, as well as the internal "trading" of resources, if and as far as allowed by the game rules.
Payment
- You can register to eRepublik for FREE. In addition, if you want to advance faster and access easier some features within eRepublik, you can buy with real money the so called "eRepublik currency" named "eRepublik Gold". The "eRepublik Gold" is a limited license right, available for purchase or free distribution at ERPK Web discretion, and is not redeemable for monetary values.
- You acknowledge that eRepublik presently includes a component of in-world fictional currency ("eRepublik Gold" or "Gold"), which constitutes a limited license right to use a feature of our product when and if allowed by ERPK Web. ERPK Web may distribute eRepublik Gold without charge, in its sole discretion. Regardless of the terminology used, eRepublik Gold represent a limited license right governed solely under the terms of this Agreement, and are not redeemable for any sum of money or monetary value from ERPK Web at any time. You agree that ERPK Web has the absolute right to manage, regulate, control, modify and/or eliminate eRepublik Gold as it sees fit in its sole discretion, in any general or specific case, and that ERPK Web will have no liability to you based on its exercise of such right.
- Besides Gold, eRepublik includes also in-world fictional currency named similar with real world currencies. As Gold, those fictional currencies are not redeemable for their actual monetary value and can be used only within the eRepublik world.
- ERPK Web may add new services for additional fees and charges, or pro actively amend fees and charges for existing services, at any time in its sole discretion.
- The user is not entitled to claim refunds except if the membership was terminated by ERPK Web and the user did not cause the termination through a breach of the Terms and Conditions, the Game/Forum Rules or the applicable law.
Intellectual property rights
- eRepublik is a trade mark in course of being registered.
- Materials available on this website, such as information, software, data, text, photographs, graphics, sound and video, are protected by copyright and other intellectual property rights of ourselves or our business partners / suppliers / advertisers. You may not use these materials or this website except to play in eRepublik in accordance with these terms of use and for personal and non-commercial use only. If you still want to use one of these materials, we must have the prior written consent of their owner.
- Users of eRepublik can create Content on the site in various forms. ERPK Web acknowledges and agrees that you will retain any and all applicable copyright and other intellectual property rights with respect to any Content you create on the website, to the extent you have such rights under applicable law.
- You also agree that by submitting your Content to any area of the site, you automatically grant to ERPK Web and to all other users of eRepublik a non-exclusive, worldwide, fully paid-up, transferable, irrevocable, royalty-free and perpetual License, under any and all patent rights you may have or obtain with respect to your Content, to use your Content for all purposes within our site.
- You agree that your Content creation is not in any way based upon any expectation of compensation from ERPK Web.
Availibility
- We will endeavor to make our website available but cannot guarantee that our website will operate continuously or without interruptions or be error free; therefore we can accept no liability for its unavailability. We reserve the right to suspend operations on the website at any time without notice for repair, maintenance or improvement.
- We make no promise that this website will be fully or partially operative on any specific computer equipment or with any specific software or that it is viruses free or anything else which may have a harmful effect on any technology.

Applicable law
Romanian law is exclusively applicable for all legal matters in regard to ERPK Web. If several jurisdiction areas are applicable, the jurisdiction area is the one which governs ERPK Web. In international legal matters the courts at the jurisdiction of ERPK Web are solely responsible.

According to law no. 677/2001 for people protection concerning the processing of personal information and their free circulation, modified and added up, and to law no. 506/2004 , concerning the processing of personal information and the protection of private life in the electronic communication domain, SC ERPK WEB SA, whose office is on 53rd Calea Plevnei, 4th Floor, Sector 1, Bucharest, Trade Register number J40/6578/2008, company number 23710295, must safety and only for specified purposes administrate the personal information you send to us.
Personal informations collected from www.erepublik.com by SC TEVIN SOLUTIONS SRL operator number 5711 have been transfered to SC ERPK WEB SA, according to the commerce fund sell-buy contract, together with the www.erepublik.com website. In care that you do not agree with the processing of your personal informations by SC ERPK WEB SA, please exert your right of opposing and to ask for the removal of your account by handling a dated and signed request at the office of SC ERPK WEB SA on 53rd Calea Plevnei, 4th Floor, Sector 1, Bucharest.
ERPK WEB SA has the right to modify without any notice or formality any statement of this Legal Note. Any modification is accepted by the users of the website and/or visaed personsby simply using any feature offered by the websiteor by simply accesing the site occured after the modification was made, and unaccepting any modification involves the obligativity of that user and/or visaed person to cease at once the access in the website or the use in any way of provided services and to ask ERPK WEB SA society the removal of the account by handling a dated and signed request at the office of SC ERPK WEB SA on 53rd Calea Plevnei, 4th Floor, Sector 1, Bucharest.
Filling in the register form (eRrepublik World "citizen") and accessing the "register" button, the participant declare that he gives the deliberate and unequivocal consent to have his personal information entered the database of SC ERPK WEB SA, processed and used in the future by our company, in conditions and for purposes mentioned in the present legal note.
All people who filled in the register form (eRepublik World "citizen") have the statue of visaed persons according to Law no. 677/2001.
The purpose of collecting your details by SC ERPK WEB SA are the following: giving to the registered users the possibility to access one or more sections of www.erepublik.com; giving information about www.erepublik.com; making internal statistics, without any other obligations from SC ERPK WEB SA.
The consequences of denying to provide your personal information are that you will not be registered as member of www.erepublik.com and the impossibility to access one or more sections of the mentioned website.
SC ERPK WEB SA will process the personal information as long as the account of a person exists, and after the removal of the concerned account SC ERPK WEB SA will turn this personal information in anonymous one and will process them in order to obtain internal statistics, during the existence of the company.
Your personal information will be used by SC ERPK WEB SA and will not be supplied to third parties, excepting subsequent owners ( assignees or purchasers ) of www.erepublik.com website or eventual commissioners of SC ERPK WEB SA.

Filling in the register form (eRepublik World "citizen") and accessing the "register" button, the participant declare that he gives the deliberate and unequivocal consent to have his personal information to be hosted abroad (Switzerland) according to the contract between SC ERPK WEB SA as the beneficiary of the hosting services and Genotec AG - Internetdienste ohne Kompromisse, din Binningerstrasse 95, 4123 Allschwil, Elvetia
Filling in the register form (eRepublik World "citizen") and accessing the "register" button, the participant declare that he gives the deliberate and unequivocal consent to have his personal information to be hosted abroad (Switzerland) or in any other country that ERPK WEB SA willmake public to all visaed persons by displaying it on the www.erepublik.com webpage.
In case that you, as a visaed person, do not agree with the choice made, you can exert your right of opposing and to ask for the removal of your account by handling a dated and signed request at the office of SC ERPK WEB SA on 53rd Calea Plevnei, 4th Floor, Sector 1, Bucharest.
