Charter of Sol


Preamble
WE THE PEOPLES OF SOL AIM FOR
  1. peace and stability in the Asia-Pacific region;
  2. forging closer relations between the governments and peoples of member nations;
  3. ensuring the security of member nations,
AND FOR THESE ENDS
  1. live together in peace with one another as good neighbours;
  2. to unite our strength to maintain regional peace and security;
  3. to ensure that armed force shall not be used against one another;
  4. to employ diplomatic machinery for the promotion of the economic and social advancement of the Asia-Pacific;
HAVE RESOLVED TO COMBINE OUR EFFORTS TO ACCOMPLISH THESE AIMS
Accordingly, our respective Governments, through representatives, have agreed to the present the Charter of Sol and do hereby establish a regional organization to be known as Sol.
Definitions
  • "Abstain", shall be defined as a vote by a Member nation in which the nation has no opinion on a proposal put before the Security Council.
  • "Advisory Representative(s)", shall be defined as person(s) selected by the President of a Member nation to advise their Representative on the Security Council.
  • "Chairman", shall be defined as the Security Council elected nominee that presides over meetings of the Security Council and conducts its business in an orderly fashion as well as acting as Sol's leader, its representative to the outside world and its spokesperson, also having voting powers in the Security Council.
  • "Emergency Resolution(s)", shall be defined as a proposal that only the Chairman of the Security Council may propose, which does not require discussion prior to voting, having a time frame of twelve (12) hours for Member nations to vote.
  • "Envoy(s)", shall be defined as the diplomatic representative from Observer nations.
  • "In favour", shall be defined as a vote by a Member nation in which the nation agrees with the proposal put before the Security Council.
  • "Majority decision", shall be defined as a vote by Member nations which meets or exceeds 60% of Security Council votes.
  • "Member(s)" and "Member Nation(s)" shall be defined as a nation or nations who have signed this treaty and have appointed a Representative to the Sol Security Council.
  • "Nominee", shall be defined as a citizen of any Member nation that is nominated for the position of Chairman or Deputy Chairman.
  • "Not in favour", shall be defined as a vote by a Member nation in which the nation disagrees with the proposal put before the Security Council.
  • "Observer(s)", shall be defined as a nation which as been admitted into Sol with Observer status, with no ability to vote on the Security Council, only to discuss issues with Sol.
  • "Principal Organ(s)", shall be defined as an agency or agencies of Sol designated to serve Sol with specific tasks.
  • "Representative(s)", shall be defined as the President of a Member nation, or person who has been selected by the President of a Member nation to represent their nation in Security Council.
  • "Security Council", shall be defined as the voting and legislative body of the Sol.
  • "Standard Resolution(s)", shall be defined as a proposal that follows standard procedure that is 48 hours of discussion prior to voting, in which it will have a time frame of twenty-four (24) hours for Member nations to vote.
  • "Supermajority decision", shall be defined as a vote by Member nations which meets or exceeds 80% of Security Council votes.
  • "Vice Chairman", shall be defined as the Security Council elected nominee that aids the Chairman in their duties but does not have voting powers.
Chapter I: Purposes and Principles
Article 1
The Purposes of Sol are:
  1. To maintain regional peace and security;
  2. To develop friendly relations among member nations based on respect for the principle of equal rights and tolerance of peoples, and to take other appropriate measures to strengthen regional peace;
  3. To achieve regional co-operation in solving regional problems of an economic, social, cultural, or humanitarian character,
Article 2
Sol and its Members, in pursuit of the Purposes stated in Article 1, shall act in accordance with the following Principles:
  1. Sol is based on the principle of the sovereign equality of all its Members.
  2. All Members, in order to ensure to all of them the rights and benefits resulting from full membership, shall fulfill in good faith the obligations assumed by them in accordance with the present Charter.
  3. All Members shall settle their regional disputes by peaceful means in such a manner that regional peace and security, and justice, are not endangered.
  4. All Members shall refrain in their regional relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of Sol.
  5. All Members shall give Sol assistance in action it takes in accordance with the present Charter, and shall refrain from giving assistance to any state endangering peace and security of the Asia-Pacific.
  6. All Members are free to participate in external alliances or engage in military, economic or political activities with any nations that do not threaten the peace, stability and security of the Asia-Pacific.
  7. Nothing contained in the present Charter shall authorize Sol to intervene in matters which are essentially within the domestic jurisdiction of Member nation
  8. Every power neither restricted by this Charter, nor granted to Sol is to be retained by each Member nation.
Chapter II: Membership
Article 3
MEMBERSHIP
  1. Membership in Sol is open to nations within the Asia-Pacific region which adhere to the obligations contained in the present Charter and, in the judgment of Sol, are able and willing to carry out these obligations.
  2. The admission of any such state to membership in Sol will be effected by a majority decision of the Security Council.
  3. A Member nation may leave Sol given that there is a minimum of ten (10) days notice to the Security Council, prior to departure.
Article 4
MEMBER STATUS
  1. Members of Sol may have one (1) Representative on the Security Council with voting rights.
  2. Members of Sol may have three (3) Advisory Representatives on the Security Council with no voting rights.
  3. Members of Sol shall follow the rules and procedures set in the present Charter
Article 5
OBSERVER STATUS
  1. Observers of Sol are non-members granted with the privilege to participate in discussions of the Security Council
  2. Observers of Sol do not have voting rights.
  3. Observers of Sol function as diplomatic representatives to Sol.
  4. Observers of Sol may send one (1) Envoy to Sol to represent their nation in discussions.
Chapter III: Organs
Article 6
  1. Listed below are the Principal Organs of Sol:

  1. Such subsidiary organs as may be found necessary may be established in accordance with the present Charter.
Chapter IV: The Security Council
Article 7

COMPOSITION

  1. The Security Council will consist of the following Member nations:
  • Australia
  • China
  • Japan
  • Malaysia
  • Pakistan
  • Philippines
  • Singapore
  1. Each Member of the Security Council shall have one (1) Representative with voting power which shall be chosen by the Member nation's President.
  2. Each Member of the Security Council shall have a maximum of (3) Advisory Representatives with no voting power which shall be chosen by the Member nation's President.
  3. The Security Council elected Chairman shall have one (1) vote on the Security Council.
  4. The Security Council elected Vice Chairman shall have no voting power on the Security Council.
Article 8
FUNCTIONS & POWERS
  1. The Security Council shall determine the existence of any threat to the peace, stability and security of the Asia-Pacific.
  2. The Security Council shall serve as a forum for dispute resolution between Member nations.
  3. The Security Council has the power to expel Member nations upon supermajority decision by the Security Council.
  4. The Security Council has the power to do whatever is necessary and proper to defend Member nations, and to maintain peace, stability and security in the Asia-Pacific.
  5. The Security Council may establish such subsidiary organs as it deems necessary for the performance of its functions.
  6. The Security Council shall have the power to elect a Chairman to lead Sol and the Sol Security Council.
  7. The Security Council shall have the power to elect a Vice Chairman to aid the Chairman in their duties.
  8. The Security Council shall have the power to amend the present Charter by a supermajority decision.
  9. The Security Council shall exercise power only in situations granted by Resolutions.
Article 9
VOTING
  1. Each Member nation shall have one (1) vote.
  2. Decisions of the Security Council on procedural matters shall be made by a majority decision.
  3. Decisions of the Security Council on dispute resolution between Member nations shall be made by a majority decision while Member nations involved in the dispute shall abstain from voting.
  4. Decisions of the Security Council on the expulsion of a Member nation shall be made by a supermajority decision while the Member nation involved shall abstain from voting.
  5. Issues shall have forty-eight (48) hours of discussion allotted prior to holding a vote.
  6. Standard Resolutions shall require Members to vote either in favour, not in favour or abstain in a 24 hour time period.
  7. Emergency Resolutions shall require Members to vote either in favour, not in favour or abstain in a 12 hour time period.
Article 10
CHAIRMAN
  1. The Security Council shall, on the fifteenth (15th) of each month, elect from the pool of nominees, a Chairman who will serve as a spokesperson for Sol.
  2. The Chairman has the ability to propose Emergency Resolutions which does not require any discussion prior to voting if there is an immediate threat to peace and stability in the Asia-Pacific.
  3. The Chairman may enact a voting window of no less than twenty-four (24) hours, during which all Members may vote on a Standard Resolution. If a Member has not voted within this time frame, that Member's vote will be recorded as an Abstain.
  4. The Chairman may enact a voting window of no less than twelve (12) hours, during which all Members may vote on a Emergency Resolution. If a Member has not voted within this time frame, that Member's vote will be recorded as an Abstain.
Article 11
VICE CHAIRMAN
  1. The Security Council shall, on the fifteenth (15th) of each month, elect from the pool of nominees, a Vice Chairman who will aid the Chairman of Sol.
  2. The Vice Chairman cannot vote on Security Council Resolutions.
  3. The Vice Chairman may propose Standard Resolutions to the Security Council.
  4. The Vice Chairman may not propose Emergency Resolutions to the Security Council.
Chapter V: Amendments
Article 12
  1. Amendments to the present Charter (which are not related to Article 6 or 7) shall come into force for all Members of Sol when they have been adopted by a unanimous vote of the Security Council and ratified in accordance with their respective constitutional processes.
  2. Upon creation of a new Principal Organ, this Charter shall be amended to include the new Principal Organ in Article 6.
  3. Upon closure of a Principal Organ, this Charter shall be amended to exclude the closed Principal Organ in Article 6.
  4. Upon admission of a new Member nation, this Charter shall be amended to include the new Member nation in Article 7.
  5. Upon a Member nation leaving Sol, this Charter shall be amended to exclude the former Member nation in Article 7.
  6. Upon expulsion of a Member nation, this Charter shall be amended to exclude the former Member nation in Article 7.
Chapter VI: Ratification and Signature
Article 13
The present Charter shall be ratified by the signatory states in accordance with their respective constitutional processes.
