USWP Constitution

The Constitution of the United States Workers Party is the governing document of the United States Workers Party. It was made official on November 10th, 2008, during Rocco Baldelli's Presidency. The constitution was written by Lukasz Makowski with the help of ProggyPop. The constitution was amended successfully on August 5th, 2009, after a week long vote by general membership, following the unanimous approval by the Executive Board. The amendments were written by GoBucks and proposed by Zcia because GoBucks was not serving on the E.B. at the time. The most recent revision (Revision 5) was passed by the general membership of the party on September 13, 2010, and can be seen in full below.

The Constitution of the United States Workers Party

Preamble

In the interests of workers, consumers, employers, managers, and all citizens of the United States, the United States Workers Party exists to promote fairness, justice, and an egalitarian society. The United States Workers Party promotes a workers society, strengthening the American economy, bringing accountability to government, and prosperity for all. With the recognition that all Americans are workers, the United States Workers Party advocates for equality and justice for all.

Definitions

The articles of this constitution are the laws that now govern the party. All amendments to the articles of may appear to be repeats and are there for historical purposes. If any amendments have been marked with the “strike-through tag”, this shall indicate that the amendment is no longer in effect.

Article I: Name

Name

• The name of the political party shall be the United States Workers Party.
• The party acronym shall be USWP.

Article II: General Membership

General Membership

• All registered members of the USWP shall be considered general members.
• A member shall be considered register at all times they are, in good standing, registered on Erepublik as a USWP party member.

Rights and Privileges

• All general members, in good standing, shall be provided with the same rights and privileges as any other general member.
• General members shall be afforded the right to;
  • Participate in internal USWP elections
  • Join and participate in the USWP party forums and IRC
  • Contribute to USWP political activities
  • Receive assistance from USWP programs.
  • Work for and receive related benefits from any USWP run business

Article III: Executive Board

Membership

• The Executive Board shall encompass the "Party Leadership."
• All positions described within Article III of this Constitution shall be considered members of the Executive Board.
  • All USWP Executive Board members shall maintain all the rights and privileges of general membership.
  • All members of the Executive Board will be appointed by the Party President, or in absence thereof, the Chief of Staff (acting as pro-tem Party President).
• The Party President or Chief of Staff shall maintain and update the list of Executive Board members on a monthly basis.

Duties

• All Executive Board members shall do their best to attend Emergency Executive Board meetings.
  • Emergency meetings may be called by any three (3) Executive Board members, the Party President or the Chief of Staff not less than 24 hours before said meeting.
• Executive Board members shall vote on any confirmation, impeachment, or replacement appointments as necessary or where there is no general agreement for a certain decision.
• Executive Board members shall be responsible for reporting on their activities to other Executive Board members, and the general membership as to maintain a transparent party leadership.
  • Violators of Art III § B Cl. 3 shall be open to removal by a 2/3rds vote of the Executive Board by those present with a minimum of three (3) Executives present or by the Party President or Chief of Staff subject to a showing of proof.

Party President

• The Party President shall be the official elected leader of the USWP.
• The Party President shall be elected by the rules and processes of the eRepublik Party President elections.
  • A candidate for Party President shall have a minimum of one month membership in the Executive Board in order to receive the backing of the Executive Board and USWP party for Party President.

Powers

• • May run or designate a candidate for USA President.
  • May call an emergency meeting of the Executive Board, if necessary, pursuant to the rules of this Constitution.
  • May appoint all Executive Board members, as necessary, subject to an advisory meeting with the Chief of Staff and the Executive Board.
  • Must have access to all and any USWP funds.

Responsibilities

• • Shall act as the premier spokesperson of the USWP on domestic and foreign issues.
  • Shall operate the day to day affairs of the party.
  • Shall oversee the activities of the Executive Board.
  • Shall do whatever may be necessary and proper to pursue the purpose and goals of the USWP proscribed in this Constitution.
  • Shall ensure all Executive Board members follow their directives to advance the party.
  • Shall maintain relations with foreign parties as necessary.

Chief of Staff

• The Chief of Staff shall act as the second in command of the USWP.

Powers

• • May act as pro-tem Party President if a vacancy should occur.
  • May have restricted* access to, and permission to temporarily move (in case of security breach), any and all USWP funds.
  • May appoint a Deputy Chief of Staff to aid in their duties. The Deputy shall not have the powers assigned in Article III Subsection D.2 Clauses i through ii.

Responsibilities

• • Must organize, oversee and coordinate the activities of the Executive Board.
  • Must assist the President with day to day operations.
  • Must maintain relations with domestic and foreign parties as necessary alongside of the Party President and the Public Affairs Director.
  • Must maintain lists of Executive Board members and USWP Organizations.
    • Explanation: The Chief of Staff should never have to access the funds except in cases where a security breach has occurred or when they are helping the Member Services Director

Member Services Director

• The Member Services Director shall be the Executive Board member in charge of directing party education, legal and business matters.

Powers and Responsibilities

• • May help operate all (non-militia) party-owned businesses.
  • Must oversee and organize the Member Services Department staff.
  • Must direct and coordinate the efforts of to message every new citizen of the United States and new USWP members on a daily basis.
  • Must run other activities as applicable under this section.

Political Action Committee Director

• The Political Action Committee Director (henceforth referred to as the PAC Director) shall be the Executive Board member in charge of political activity.

Powers and Responsibilities

• • Must operate the Congressional Political Action Committee.
  • Must oversee and coordinate the activities of the Political Action Committee Staff.
  • Must oversee and promote all campaign activities of the USWP.
  • Must coordinate any and all internal elections.

Legal Department Director

• The Legal Department Director shall be the Executive Board member charged with maintaining the USWP Constitution and advising the Executive Board on its directives.

Powers

• • May commit new changes to the Constitution subject to approval by the Executive Board and the general assembly of members on the forums.
  • May censure members of the Executive Board for overstepping their legal bounds.

Responsibilities

• • Must be aware of day-to-day operations of Executive Board members.
  • Must be current on the laws and procedures of the United States.
  • Must be accessible to both Executive Board and general assembly members for advice on legal matters pertaining to both the USWP Constitution and the United States laws and procedures.

Communications and Public Affairs Director

• The Public Affairs Director shall be the Executive Board member in charge of public relations, media outreach, and inter-party relations.

Powers and Responsibilities

• • Must assist all candidates and party members with media contact.
  • May draft party talking points when necessary.
  • May craft and implement a public relations plan and maintain the image of the party to the public.
  • Must organize a mass message to the party when the Party President* requests it, but no more than twice a month. An extra message may be required in case of a suspected PTO or to aid in another party's ATO.
    • If the Chief of Staff is acting as pro-tem Party President, he or she may also request a party mass message to be organized, especially if an election for the Party President must be organized.

Workers' Militia Commander

• The Workers' Militia Commander shall run the United States Workers Party's militia, the WORKERS MILITIA.

Powers and Responsibilities

• • Must operate the Workers Militia.
  • Must organize and oversee the activities of the Militia Staff.
  • Will coordinate efforts with the Member Services Director to ensure weapons are available for members of the militia.
  • Will work with the Public Affairs Director to promote the Workers Militia.

Information Technology Administrator

• The IT administrator shall oversee all technological applications of the party including, but not limited to, IRC Channels, Web Pages, and the Forum.

Powers

• • Shall maintain the forums to ensure operational efficiency and ease of use.
  • Shall maintain a listing of USWP IRC Channels and their administrative passwords.
  • Shall oversee all technology based advances of the party.
  • Shall not have the power to vote on Executive Board Proposals unless granted by the Party President.

Executive Board Member Emeritus

• An Executive Board member Emeritus shall assist in providing experience and insight to the Executive Board.
  • A member must have served at least one month on the Executive Board to be an Executive Board Member Emeritus.
  • An Emeritus member may be removed after a two-thirds majority vote by the Executive Board if the Emeritus member poses a security risk. Inactivity is only a matter of security when the Emeritus member’s accounts have been hacked.

Powers

• • Shall act as an adviser to the Executive Board.
  • Shall provide insight where needed.
  • Shall assist in training new Executive Board Members.

Exceptions

• • Shall not be required to report on activities.
  • Shall not have the power to vote on Executive Board Proposals unless granted by the Party President.

Intelligence Department Director

• The Intel Department Director shall be the Executive Board member in charge of gathering information to protect the security of the USWP.

Powers and Responsibilities

• • Will operate the Intel Department.
  • Must approve all USWP Congressional Candidates with regards to the risk that candidate may provide to the safety of the USWP and the USA.
  • May oversee actions across party lines to ensure the prevention of PTOs.
  • Must oversee and coordinate the activities of the Intel Department Staff.

Article IV: Executive Staff

Membership

• The Executive Staff shall constitute the staff of any Executive Board member and any other positions hereafter discussed.

Powers

• The Executive Staff shall be non-voting members of the Executive Board.
• Executive Staff members may attend Executive Board meetings but may not speak unless recognized by the Party President or the staff members immediate supervisor.
• Executive Staff members shall be constrained to the responsibilities assigned by their supervisor, except for any position explicitly discussed in this Constitution, who shall be bound to powers outlined hereafter.

Article V: Vacancy, Impeachment, Replacement

Party President

• The Party President seat shall be considered vacant when;
  • S/He resigns from office
  • Is banned from Erepublik
  • Is impeached
• A vote of impeachment may occur with a 2/3rds vote for impeachment by the Executive Board.
  • If impeachment proceedings occur, a vote shall be taken from the general membership of USWP.
  • If a majority of the USWP membership move for impeachment, the Party President is considered vacant.
• If the Party Presidency is considered vacant, new elections must occur within five (5) days, unless the monthly scheduled Party President election is, at most, ten (10) days away
  • Any general member may run as a candidate in a replacement election.
  • A candidate with a plurality of votes shall be deemed the Party President pursuant to the rules of Erepublik.
  • The duly elected Party President shall maintain office until the next monthly Party President election.
  • The Chief of Staff shall be the acting Party President at any point when the position is vacant and a new Party President has not been elected.

Other Executive Board Members

• All other Executive Board seat shall be considered vacant when;
  • An Executive Board member resigns from office
  • Is banned from Erepublik
  • Is impeached by the Executive Board.
  • Is inactive following Art III § B Cl. 3
• Impeachment shall occur with a simple majority vote by the Executive Board.
• In case of security breach, the Party President, Chief of Staff and/or IT Administrator may remove an Executive Board member’s access to the Executive Board channels and forums. If an impeachment vote is not taken within one week of the member’s removal, his access must be returned.

Article V: Amendments

Executive Board Initiated

• A referendum on any Constitutional amendment shall take place if such amendments are approved by a majority 2/3 vote of the Executive Board.
  • The Party President may directly propose amendments to the Executive Board.
• If a majority of the general membership that vote approve an Executive Board proposed amendment, the amendment shall pass.

General Membership Initiated

• A referendum on any Constitutional amendment shall also take place upon receipt by the Chief of Staff of a petition in favor of amending by 10% of the general body.
• If 30% of the general membership approves a general membership proposed amendment, the amendment shall pass.

Article VII: Party Convention

Party Convention

• The Party President or the Chief of Staff may convene a party convention at most once a month.
  • The organizing aspect of the convention shall be the responsibility of the Communications Department Director, unless specified otherwise by the Party President or the Chief of Staff.
• All Executive Board members shall have a right to report on their business to the general membership at a party convention, or designate a spokesperson on their behalf.
• All impending Constitutional referendum or impeachment proceedings must be announced at a convention.
• General members shall have a right to speak at a time designated by the Party President, or the appropriate convention administrator. All members are guaranteed three minutes of speaking time, but must notify the Party President or Chief of Staff of their intentions to speak prior to the convention.

Article VIII: Grievances

Grievance Process

• All grievances must be addressed to the Chief of Staff in writing.
  • A grievance against the Chief of Staff must be addressed to the Party President or to another Executive Board member if the grievance affects both.
• The Executive Board must hear and address any grievance at the next Executive Board meeting, at which point the grieving party shall have a right to address the Executive Board as a whole.
• The handling of a grievance shall not take the place of proper impeachment proceedings identified in this Constitution.

Amendments

Amendment I: Executive Board Member Emeritus

• An Executive Board member Emeritus shall assist in providing experience and insight to the Executive Board.
  • A member must have served at least one month on the Executive Board to be an Executive Board Member Emeritus.

Powers

• • Shall act as an adviser to the Executive Board.
  • Shall provide insight where needed.
  • Shall assist in training new Executive Board Members.

Exceptions

• • Shall not be required to report on activities.
  • Shall not have the power to vote on Executive Board Proposals unless granted by the Party President.

Amendment II: Business Affairs Department

*The Business Affairs Department Director shall be the Executive Board member in charge of any and all business and financial matters regarding the USWP.

• • The Business Affairs Department Director shall replace the Labor Department Director and Finance Department Director Executive Board positions.

Powers

• • Shall organize and coordinate the Business Affairs Department staff.
  • Shall have the responsibility to create fundraising opportunities as needed.
  • Shall manage any loans borrowed to and from USWP.
  • Shall act as an economic adviser to the Party President, the Chief of Staff and the Executive Board.
  • Shall manage the USWP Escrow Service.
  • Shall provide advice and assistance to USWP business owners.
  • Shall publicize and maintain a list of USWP party and member run businesses.
  • Shall run other activities as applicable under this section.

Amendment III: Wellness Center Discontinuation

• The Wellness Center shall be disbanded.
  • The forum will remain hidden and all references to the wellness center in the USWP Constitution will be striked through.
• Remaining Assets
  • All remaining monetary assets from the wellness center shall be given to the Business Affairs Department.
  • All remaining account names and passwords shall be turned over to the Chief of Staff.

Amendment IV: Changes to USWP Party President Vacancy Elections

After the passage of this amendment Article V Section A Paragraph 3 Lines i-iv shall read:

• If the Party Presidency is considered vacant, new elections must occur within five (5) days, unless the monthly scheduled Party President election is, at most, ten (10) days away
  • Any general member may run as a candidate in a replacement election, pursuant to Article III Section C of this constitution.
  • A candidate with a plurality of votes shall be deemed the official Party President pursuant to the rules of Erepublik.
  • The duly elected Party President shall maintain office until the next monthly Party President election.
  • The Chief of Staff shall be the acting Party President at any point when the position is vacant and a new Party President has not been elected.

Amendment V: Changes to Executive Board Duties

After the passage of this amendment Article III Section B shall read:

Amendment VI: Minor Change To Amendment Procedure For Clarification Purposes

After the passage of this amendment Article VI Section A Line 2. shall read:

• If a majority of the general membership that vote approve an Executive Board proposed amendment, the amendment shall pass.

Amendment VII: Addition of the Intel Department

Intel Department Director

• The Intel Department Director shall be the Executive Board member in charge of gathering information to protect the security of the USWP.

Powers

• • Shall operate the Intel Department.
  • Shall approve all USWP Congressional Candidates with regards to the risk that candidate may provide to the safety of the USWP and the USA.
  • Shall oversee actions across party lines to ensure the prevention of PTOs.
  • Shall oversee and coordinate the activities of the Intel Department Staff.

Amendment VIII: Update of Duties of Some EB Members

After the passage of this amendment Article 3 Section D Line 2iii Shall Be Added to Article 3 Section I so that Section D of Article 3 reads:

Chief of Staff

• The Chief of Staff shall act as the second in command of the USWP.

Powers

• • Shall organize, oversee and coordinate the activities of the Executive Board.
  • Shall assist the President with day to day operations.
  • Shall coordinate any internal elections.
  • Shall act as pro-tem Party President if a vacancy should occur.
  • Shall maintain relations with domestic and foreign parties as necessary alongside of the Party President.
  • Shall have access to all and any USWP funds."

Furthermore, current Article 3 Section I Lines 2ii, 2iv, 2v shall be removed so that Section I of Article 3 reads:

Legal Department Director

• The Legal Department Director shall be the Executive Board member in charge of any and all legal matters regarding the USWP.

Powers

• • Shall organize and coordinate the Legal Department staff.
  • Shall give advice on contracts and arbitration to USWP members and USWP.
  • Shall maintain this Constitution.
  • Shall be the USWP Parliamentarian."

Amendment IX: Party Primary System

Nominations

• Any eUS citizen in good standing can be nominated for consideration to be the USWP Presidential Candidate.
  • Only USWP Members may nominate a citizen for consideration.
• All nominees must formally accept their nomination within the USWP Forums.
• No preference will be given to the Executive Board in their nominations.
• A thread for nominating should be open no earlier than the 26th of each month and as late as the 28th of each month.
  • Creating a thread for nomination will be the responsibility of the Chief of Staff.

Debate/Discussion

• Upon accepting their nomination all nominees should open a thread in the Primary Forum regarding their run for presidency.
• All members are allowed to comment on the thread and ask appropriate questions, addressed to the nominee.
• Debate should end when voting begins with the Chief of Staff locking all debate threads.
  • If the Chief of Staff is a nominated party, and he/she accepts, the responsibility falls to the Legal Department Director.

Voting Process

• Voting in the primaries is closed to all non-USWP members.
• The vote shall begin no earlier than the last day of each month and no later than the 2nd of the month.
  • The process should be open for no fewer than 24 hours.

Candidacy

• The nominee receiving the most votes shall be the USWP Party Candidacy.
• If voter fraud is detected the decision can be overthrown by a simple majority vote of the USWP E.B.
  • All voter fraud evidence must be displayed to the public.
  • If the decision is overthrown the E.B. must select the new candidate in a caucus, which will be released to the public.

Amendment X: Jude Connors' Amendment of Awesomeness

After the passage of this amendment Article 3 Sections D-L shall read:

Chief of Staff

• The Chief of Staff shall act as the second in command of the USWP.

Powers

• • Shall organize, oversee and coordinate the activities of the Executive Board.
  • Shall assist the President with day to day operations.
  • Shall act as pro-tem Party President if a vacancy should occur.
  • Shall maintain relations with domestic and foreign parties as necessary alongside of the Party President and the Public Affairs Director.
  • Shall have access to all and any USWP funds.
  • Shall maintain lists of Executive Board members and USWP Organizations.

Recruitment Director

• The Recruitment Director shall be the Executive Board member in charge of all recruitment activities of the USWP.
  • The Recruitment Director shall replace the Institute Director position.

Powers

• • Shall operate the Recruitment Department.
  • Shall oversee and coordinate the activities of the Recruitment Department staff.
  • Shall oversee efforts to mass mail every new USA citizen and new USWP member on a daily bases.
  • Shall craft and implement a recruitment and orientation plan.

Member Services Director

• The Member Services Director shall be the Executive Board member in charge of directing party education, legal and business matters.
  • The Member Services Director shall replace the Legal Department Director and the Business Affairs Department Director positions.

Powers

• • Shall oversee and organize the Member Services Department staff.
  • Shall operate all party businesses.
  • Shall direct and coordinate the efforts of The Workers' University.
  • Shall maintain the USWP Constitution and oversee all legal matters regarding the party.
  • Shall run other activities as applicable under this section.

Elections Director

• The Elections Director shall be the Executive Board member in charge of political activity.

Powers

• • Shall operate the Congressional Political Action Committee.
  • Shall oversee and coordinate the activities of the Elections Committee staff.
  • Shall oversee and promote all campaign activities of the USWP.
  • Shall coordinate any internal elections.

Public Affairs Director

• The Public Affairs Director shall be the Executive Board member in charge of public relations, media outreach, and inter-party relations.

Powers

• • Shall assist all candidates and party members with media contact.
  • Shall draft party talking points when necessary.
  • Shall craft and implement a public relations plan and maintain the image of the party to the public.
  • Shall organize a weekly mass message to all members of the party.

Workers' Militia Commander

• The Workers' Militia Commander shall run the United States Workers Party's militia, the WORKERS MILITIA.

Powers

• • Shall operate the Workers Militia.
  • Shall organize and oversee the activities of the Militia Staff.
  • Shall coordinate efforts with the Member Services Director to ensure weapons are available for members of the militia.

  • Shall ensure that the militia is open to all eUS Citizens, regardless of party affiliation.

Executive Board Member Emeritus

  • A member must have served at least one month on the Executive Board to be an Executive Board Member Emeritus.

Powers

• • Shall act as an adviser to the Executive Board.
  • Shall provide insight where needed.

IT Administrator

Amendment X: Post-Reconstruction Amendment

Article III Section A Clause 2 Line ii shall read:

Article V Section B Clause 1 Line iv rewritten from “is impeached” to “is impeached by the Executive Board”

Article V Section B Clause 3 added to read “In case of security breach, the Party President, Chief of Staff and/or IT Administrator may remove an Executive Board member’s access to the Executive Board channels and forums. If an impeachment vote is not taken within one week of the member’s removal, his access must be returned.”
